If you should choose to utilize PanoPerfect app (the "Service") you agree to be bound by these "Terms of Use". Should you disagree or otherwise choose not to follow the Terms of Use, do not use the Service.
In accordance with these Terms of Use, we grant limited, personal, non-exclusive, non-transferable license to use the Service for your personal use only. Sale or redistribution of this product is strictly prohibited.
With the exception of this license of limited use, PanoPerfect retains all rights, title, and interest in and to the Service, including all associated intellectual property rights as protected by applicable intellectual property laws, including United States copyright law and international treaties.
Except as otherwise explicitly allowed in the Terms of Service or plainly permitted by applicable laws, you cannot and will not allow third parties to reproduce, modify, translate, enhance, decompile, disassemble, reverse engineer, or create derivative works of the Service. Also you may not rent, lease or sublease, or sub license access to the Service or otherwise circumvent or disable any security or technological features of the Service.
PanoPerfect does not and will not provide the equipment to access the Service. We reserve the right to discontinue or modify any or all aspects of the Service without notice. In addition we will not be liable for any third party modification, suspension, or discontinuance of the Service.
PanoPerfect reserves full discretion to reject, refuse or remove any posting by you, or to restrict, suspend, or terminate your access to the Service at any time without notice.
In your use of the Service, you agree to indemnify, defend and hold harmless PanoPerfect, its affiliates, successors, assigns, officers, employees and agents from and against all action, causes of action, claims and demands whatsoever, and from all costs, damages, expenses, charges, debts and liabilities whatsoever (including attorneys’ fees), whether known or unknown, present or future, that arise from, out of or are connected with: (a) your breach of any term or terms in this Terms of Use; or (b) a claim that your use of the Service infringes or misappropriates any patent, copyright, trade secret, trademark or other intellectual property or proprietary right of a third party.
You must be in full compliance with all applicable laws, including U.S. export control laws when utilizing the Service. Except as allowed by applicable law or authorized by PanoPerfect in writing, you shall not permit any person or company to store, copy, modify, distribute, or resell any media products such as audio, visual, or audiovisual products or any other content available on the Service.
Do not upload anything that is not yours. This includes other people's photos that you copied or collected from the Internet. Accounts that consist primarily of such content may be deleted.
Do not upload content that is illegal or prohibited. If we discover that you are engaging in illegal practices, your account will be deleted and appropriate action will be taken, including reporting you to the appropriate authorities.
Do not unleash your frustrations, tirades or bore other members. PanoPerfect is not a forum for you to harass, abuse, impersonate, or intimidate others. If we receive a verifiable complaint about your unacceptable or otherwise inappropriate conduct, we will send you a warning email or possibly delete your account, depending on the severity.
Do not use your account to host web graphics, such as logos, banners, or other advertising gimmicks. If we find you using your account to host graphics of web page designs, logos, icons, and other non-photographic media on other websites, we will warn you or delete your account, depending on the severity.
Do not use PanoPerfect to sell. If we find you conducting commercial sales activity, we will warn you. We reserve the right to delete your account if this abuse continues. Some examples include selling products, services, or yourself through your photostream or in a group, using your account solely as a product catalog, or linking to commercial websites in your photostream.
Let's protect the children. If you would hesitate to show your photos to a child, your parents, or other family members, that means you should not upload the photo.
Don't show nudity in your profile or cover photos. Only content considered "safe" is appropriate for your thumbnail icon. If we find that you have uploaded a thumbnail icon that contains inappropriate content, we will remove the thumbnail icon, mark your account as "restricted" and send you a warning. If we catch you repeating this practice, we will delete your account.
You may see photos on the feed or popular page which may offend you. If you are offended by a photo, you can either click away or you can mark it as poorly moderated by clicking on the "flag this photo" link on a photo page. If you think there is immediate cause for concern, you can report content and/or someone's behavior to PanoPerfect staff via the "Report Abuse" link that is available in the footer of every page. Note: Please report the exact page that the offensive content appears. We need this information to correct the situation.
The Service collects voluntarily provided information about you during the registration process such as name and phone number. If you become a registered user, you may provide additional optional information on your profile page. It is not our intention to use this information to personally identify you. PanoPerfect reserves the right to change this privacy policy as needed. Revisions to the privacy policy will be posted on the website.
PanoPerfect uses your information primarily to provide and enhance your use of the Service. The information is also utilized to verify your right to access the Service and allow us to notify you as needed. Email addresses may be used to contact other users, provide notifications about the status of your account, promotions, or new products and services. You should be aware that any voluntarily disclosed personal information can be collected, correlated, and used by third parties and may result in unsolicited messages from other users or third parties. Such activity is beyond the control of PanoPerfect. Do not post any personal information in the application or in other areas that require privacy.
PanoPerfect may disclose your personal information to third parties at our sole discretion. Therefore, do not disclose any information that you do not want shared with a third party. Accordingly, PanoPerfect will disclose any information to comply with any applicable law, regulation, or other government authority or to prevent harm. PanoPerfect may also contract with third parties to provide hosting and other services necessary to maintain the Service. Payment processing or other administrative functions may also be performed by third parties. In the case of third party involvement, PanoPerfect will use commercially feasible methods to prevent third parties from disclosing your personal information, except as necessary for providing their respective services.
PanoPerfect accounts are secured by voluntarily provided information submittals and user-created passwords. No guarantee is given regarding the security of the user account information. Unauthorized entry or use, hardware, or software failure or other circumstances may compromise the security of user information.
We do not knowingly collect information from children under the age of 13. We will promptly delete any such information. By providing your personal information to PanoPerfect, or through the website, you certify that you are 13 years of age or older.
PanoPerfect provides no warranty expressed or implied that error-free service will be provided at any time under the privacy policy. Reasonable efforts will be taken to comply with the stated privacy policy. We welcome your suggestions regarding your privacy concerns.
